WI Supreme Court Issues “Temporary Mailbox Rule”

The WI Supreme Court has now created a "Temporary Mailbox Rule" for those attorneys who do not have access to the Court System's eFiling system.

Due to the “Safer-at-home” order by Gov. Tony Evers, as well as the existing public health emergency during the coronavirus pandemic, the Wisconsin Supreme Court has strongly discouraged hand-delivery of documents. However, the Court also recognizes that there are those who are unable to access and use the electronic filing system (eFiling).

Therefore, the Court has now created a “Temporary Mailbox Rule.”

Under the rule, a document that has been correctly addressed to the appropriate clerk of court and deposited in the U.S. mail or tendered to a commercial carrier with proper postage and with a Statement of Mailing, will be deemed to have been filed as of the date of the Statement of Mailing, which is described in the order.
